1. Scope of Application

1.1 These Terms and Conditions (T&C) apply to all contracts concluded through our website, platforms, or other sales channels between GENOPUZZLE.com (hereinafter referred to as "we" or "GENOPUZZLE") and our customers.

1.2 Our services are available to customers worldwide, with a particular focus on the EU and other international markets.

1.3 Deviating or additional terms from the buyer will not become part of the contract unless we have expressly agreed to them in writing.

2. Conclusion of Contract and Place of Purchase

2.1 The purchase contract for our products or services is exclusively concluded in the United Kingdom.

2.2 By entering into the purchase agreement, the customer expressly agrees that the purchase is considered as taking place in the United Kingdom, regardless of their location.

2.3 Communication regarding the purchase, including payment processing, will take place electronically.

3. Tax Regulations (VAT)

3.1 Sales to customers outside the United Kingdom, especially within the European Union (EU), are treated as 0% VAT (tax-free) exports under UK tax regulations.

3.2 It is the buyer's responsibility to pay any local taxes or duties in their home country if applicable. GENOPUZZLE assumes no responsibility for such obligations.

3.3 Customers within the United Kingdom will be charged the applicable UK VAT (currently 20%).

4. Information for Buyers

4.1 Before entering into the purchase agreement, each buyer will be informed that:

  • The purchase agreement is concluded in the United Kingdom.
  • Sales to countries outside the UK, particularly the EU, are taxed at 0% VAT.
  • Any additional tax obligations in the buyer's home country are not assumed by GENOPUZZLE.

4.2 This information is clearly displayed on our website and in the order confirmation.

5. Payment Processing and Documentation

5.1 GENOPUZZLE ensures that the purchase process is documented as having been completed in the United Kingdom through technical means (e.g., IP address, payment data).

5.2 Payments are processed exclusively in Euros unless another currency is explicitly agreed upon.

5.3 Buyers are required to provide accurate billing and payment information to verify the purchase process.

6. Liability and Warranty

6.1 GENOPUZZLE is not liable for any tax obligations incurred by customers in their home country as a result of purchases.

6.2 The buyer is responsible for informing themselves about the tax regulations in their home country.

7. Applicable Law and Jurisdiction

7.1 All legal relationships between GENOPUZZLE and the buyer are governed exclusively by the laws of the United Kingdom.

7.2 The place of jurisdiction for disputes arising from or related to this agreement is London, United Kingdom.

8. Changes to the Terms and Conditions

8.1 GENOPUZZLE reserves the right to change these T&Cs at any time. Changes do not apply to contracts that have already been concluded.

10. Terms for the Sale of Lifestyle Genetic Tests

10.1 Nature of Offered Tests

  • The genetic tests offered by GENOPUZZLE are solely for lifestyle and wellness purposes. They are designed to provide insights into personal traits such as nutrition, fitness, and general well-being.
  • These tests are not medical diagnoses and do not replace consultation or treatment by healthcare professionals.

10.2 Not for Medical Purposes

  • Our genetic tests are not intended to diagnose, treat, cure, or prevent diseases.
  • Customers are advised to consult a physician or qualified healthcare provider for any health-related concerns.

10.3 Privacy and Consent

  • Genetic data is considered sensitive personal data. GENOPUZZLE processes this data exclusively in accordance with the UK Data Protection Act 2018 and the GDPR.
  • Customers are anonymized when reported to laboratories and explicitly consent, upon purchase, to the collection, analysis, and storage of their genetic data.
  • A detailed privacy policy is available that explains how we protect and use your data.

10.4 Use of Test Results

  • The results of our tests are intended for personal informational purposes and should not be used as the sole basis for decisions regarding health, nutrition, or fitness.
  • GENOPUZZLE assumes no liability for actions or decisions made based on test results.

10.5 No Guarantee of Results

  • The results of lifestyle genetic tests are based on the latest science but are limited by individual genetic variability and data interpretation.
  • GENOPUZZLE does not guarantee that the results are complete, error-free, or suitable for any specific purpose.

10.6 Purchase and Use of Tests

  • The purchase and use of lifestyle genetic tests are at the customer's own risk.
  • By using the tests, the customer expressly agrees to interpret and use the results at their own responsibility.

10.7 Legal Scope

  • The genetic tests are subject to the laws of the United Kingdom and are designed in accordance with the applicable regulations for lifestyle products.
  • Any local regulations in the customer's home country fall outside GENOPUZZLE's responsibility.

Use of AI Services

Our services may integrate AI-powered features for health coaching and analysis. The use of this functionality is currently included as part of the GENOpuzzle platform.

  • GENOPUZZLE is not responsible for the availability or functionality of third-party AI services.
  • AI-generated content is for informational purposes only and does not constitute medical advice.

Cancellation Policy

1. Exclusion of the Right to Cancel

As per the Consumer Contracts Regulations 2013, the right to cancel does not apply to the following:

  • Personalized Services: GENOPUZZLE's services, such as genetic and microbiome analyses, are tailored to the customer and cannot be reused.
  • Immediate Provision of Digital Content: Access to digital content (e.g., GENOPUZZLE Campus) begins immediately, and by agreeing to this, customers waive their cancellation rights.

2. Customer Agreement

By completing the purchase process, customers explicitly agree to:

  • The immediate provision of services and digital content.
  • Waiving their right to cancel.

3. No Refunds for Completed Services

Once services or digital content have been provided, no refunds will be issued.
